1. Who we are

These Terms govern your use of thehumanproblem.ai and the marketing automation and response systems provided by THP SOLUTIONS LLC ("THP," "we," "us") — Systems work (catching and converting inquiries) and Demand work (paid advertising campaigns). THP is a national remote agency. We work with companies everywhere.

2. Services

Specific engagements are described in the applicable order, proposal, or service agreement. Plans are month-to-month after any initial term unless otherwise agreed in writing.

3. Fees

Fees are set out in your agreement, billed in advance unless stated otherwise. Late or failed payments may result in suspension of services. This site does not publish pricing.

4. SMS / Text Messaging program terms

Program description. Our SMS program sends customer-care messages only: replies to your inquiry, appointment scheduling and reminders, and service updates related to work you've asked us about. We do not send marketing blasts to numbers that haven't opted in.

How you opt in. You opt in by (a) submitting the contact form at thehumanproblem.ai/contact and checking the optional, unchecked-by-default SMS consent box, which links directly to our Privacy Policy and these Terms at the point of consent, or (b) checking the optional, unchecked-by-default SMS consent box on the form shown when you book a call at thehumanproblem.ai/booking. These are the only ways we collect SMS consent. We send only customer care messages (replies to your inquiry, appointment scheduling and reminders, and account updates); we do not send marketing or promotional text messages.

Frequency, rates, and opting out. Message frequency varies based on your interaction with us. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Consent is not a condition of purchase. You must be at least 18 years old to opt in to receive SMS messages from us.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

5. Acceptable use

You may not use our services to send unlawful, deceptive, or unsolicited communications, or in violation of the TCPA, the Florida FTSA, CAN-SPAM, or carrier policies.

6. Intellectual property

We retain ownership of our tools, templates, and know-how. You retain ownership of your data, brand, and customer relationships, including your CRM data, phone numbers, and call recordings.

7. Disclaimers

Services are provided "as is." We do not guarantee results. Modeled scenarios on this site, if any, are illustrations — not promises of outcomes.

8. Limitation of liability

To the maximum extent permitted by law, THP's total liability arising out of the services is limited to the fees you paid to THP in the three months preceding the claim.

9. Governing law

These Terms are governed by the laws of the State of Florida. Venue lies in the state or federal courts located in Florida.
